Conditions of Participation: Social Media Sweepstake – 'HEINRICH DINKELACKER x Saphir Médaille d’Or'

Organizer of the sweepstake is HEINRICH DINKELACKER (hereinafter "HEINRICH DINKELACKER"), Shoepassion GmbH, Ackerstr. 23-26, 10115 Berlin, Germany, e-mail: gewinnspiel@shoepassion.com. Participation in the HEINRICH DINKELACKER competition is free of charge and is governed exclusively by these terms and conditions.

1. Course of the competition
The duration of the competition is from 06.08.2022, 2:00 p.m. to 10.08.2022, 11:59 p.m.. Within this period, users will be given the opportunity to participate in the competition online.

2. Participation
In order to participate in the competition, it is necessary to mark the feed post calling for the competition with "Like", it is necessary to comment on the feed post and link another person there, and to follow the Instagram accounts @heinrichdinkelacker and @saphir_medailledor.

Participation is only possible within the entry period. Entries received after the closing date will not be considered in the draw.

Only one submitted entry per entrant will be entered into the competition. It is strictly prohibited to use multiple email addresses or multiple social media profiles to increase your chances of winning.

Participation in the competition is free of charge.
 

3. Eligible participants
Natural persons who are resident worldwide and have reached the age of 18 are eligible to participate. Participation is not restricted to customers of HEINRICH DINKELACKER and is not dependent on the purchase of goods or services.

Should a participant be restricted in his/her legal capacity, the consent of his/her legal representative is required.

All persons involved in the conception and implementation of the competition and employees of HEINRICH DINKELACKER as well as their family members are not eligible to participate in the competition.
In addition, HEINRICH DINKELACKER reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example:
(a) in the event of manipulation in connection with access to or implementation of the sweepstake, (b) in the event of violations of these terms and conditions of participation, (c) in the event of unfair practices, or (d) in the event of false or misleading information in connection with participation in the sweepstake.

4. Winning, notification and transmission of the prize

The following prize will be awarded:
1 x A pair of HEINRICH DINKELACKER shoes and a shoe care set from Saphir Médaille d’Or

The winner will be determined after the closing date by a random draw among all participants. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the draw.

The winner of the raffle will be informed about the prize in a timely manner via a separate Instagram PM.

The prize will only be handed over to the winner or to the legal representative of the underage winner. An exchange, a self-collection as well as a cash payment of the prize are not possible.

Any costs incurred for shipping the prizes will be borne by the operator. Additional costs associated with the claiming of the prize, such as customs duties, shall be borne by the winner. The winner is responsible for any taxation of the prize.

If the winner does not report after two requests within a period of 3 weeks, the prize can be transferred to another participant.

5. Termination of the competition
HEINRICH DINKELACKER expressly reserves the right to terminate the competition without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.

6. Data protection information
Personal data of the participant will be used exclusively for the execution of the sweepstake contract, i.e. for the determination of the winners and delivery of the prizes (legal basis: Art. 6 para. 1 lit. b) DSGVO) and will subsequently be deleted 3 months after redemption of the sweepstakes prize. Any further use of the data for advertising purposes will only take place if the participant consents (legal basis: Art. 6 para. 1 lit. a) DSGVO).

In the event of a win, the winner agrees to the publication of his/her name and place of residence in the advertising media used by HEINRICH DINKELACKER. This includes the announcement of the winner on HEINRICH DINKELACKER's website and its social media platforms.

You have the right to revoke consent to the processing of data once given at any time with effect for the future. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

In addition to the right to revoke your consent given to us, you are entitled to the following further rights if the respective legal requirements are met:
- Right to information of the data subject pursuant to Art. 15 DSGVO.
- Right to rectification pursuant to Art. 16 DSGVO
- Right to erasure pursuant to Art. 17 DSGVO
- Right to restriction of processing pursuant to Art. 18 DSGVO
- Right to data portability pursuant to Art. 20 DSGVO
- Right to object to processing pursuant to Art. 21 DSGVO

7. Social media disclaimer
Insofar as a competition is carried out or announced on social media platforms (in particular Facebook or Instagram), the participant acknowledges that the competition is in no way connected to the social media platform in question and is in no way sponsored, supported or organized by it. Furthermore, the participant declares that he/she will not make any claims against these social media platforms because of the sweepstake and in this respect releases them from any liability.

8. Liability
Claims for damages by the participant are excluded. Excluded from this are claims for damages by the participant arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by HEINRICH DINKELACKER, its legal representatives or vicarious agents. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract. In the event of a breach of material contractual obligations, HEINRICH DINKELACKER shall only be liable for the foreseeable damage typical of the contract if such damage was caused by simple negligence, unless the participant's claims for damages are based on injury to life, limb or health. The aforementioned restrictions also apply in favor of HEINRICH DINKELACKER's legal representatives and vicarious agents if claims are asserted directly against them. The provisions of the Product Liability Act remain unaffected.

9. Applicable law and place of jurisdiction
HEINRICH DINKELACKER's competition is subject exclusively to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Legal recourse is excluded.

10. Severability clause
Should individual provisions of these conditions of participation be or become invalid, this shall not affect the legal validity of the remaining conditions of participation.
